These Terms of Service (“Terms”) govern your use of the Menumento mobile app and related services (the “Service”). By downloading or using Menumento, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. The Service
Menumento is a personal food-tracking app that lets you save photos, ratings, notes, and tags for restaurant, takeout, and delivery dishes, organize them by restaurant, and back them up and sync them across your devices.
2. Your account
To sync and back up your data you create an account using email and password or Sign in with Google. You’re responsible for keeping your login credentials secure and for activity that happens under your account. Let us know at support@menumento.app if you suspect unauthorized use.
3. Free plan and Premium subscription
Menumento offers a free plan and an optional paid Premium subscription.
- Free plan. Includes all core features with limits of up to 10 dishes and up to 5 restaurants.
- Premium. Removes those limits (unlimited dishes and restaurants) for $2.99 per month.
Premium is an auto-renewing subscription billed through your app store account (Apple App Store or Google Play). Your subscription renews automatically each month unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription, and use “Restore Purchases,” through your app store account settings. Prices may vary by region and are subject to change; any changes will apply to future billing periods. Except where required by law or store policy, payments are non-refundable — refund requests are handled by the app store.
4. Your content
You keep ownership of the photos, notes, ratings, and other content you add to Menumento (“Your Content”). You grant us the limited permission needed to store, back up, sync, and display Your Content to you as part of operating the Service. You’re responsible for Your Content and confirm you have the right to use any photos you upload.
5. Acceptable use
You agree not to misuse the Service. In particular, you won’t:
- Break the law or infringe others’ rights when using the app;
- Upload content that is illegal, harmful, or violates someone else’s rights;
- Attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the Service or its backend;
- Use the Service to build a competing dataset or resell access.
6. Third-party services
Menumento relies on third-party services, including Google Firebase, Google Places, and app-store billing from Apple and Google. Your use of features powered by these providers may also be subject to their terms. We’re not responsible for third-party services.
7. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don’t guarantee that the Service will be uninterrupted, error-free, or that your data will never be lost. Please keep in mind restaurant details and place information may not always be accurate or current.
8. Limitation of liability
To the maximum extent permitted by law, Menumento and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim.
9. Termination
You may stop using the Service and delete your account at any time (see Account & Data Deletion). We may suspend or terminate access if you violate these Terms or to protect the Service and its users.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll update the “Last updated” date above. Continuing to use the Service after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws principles, except where local consumer law provides otherwise.
